Do You Need a Fire Risk Assessment?

The Regulatory Reform (Fire Safety) Order 2005, reinforced by the Fire Safety Act 2021, places a legal duty on the "responsible person" of any non-domestic premises to carry out, or commission, a suitable and sufficient fire risk assessment.

Failure to have a valid assessment in place is a criminal offence. Enforcement notices, unlimited fines, and even imprisonment can follow. Your building's insurance may also be invalidated without one. The legislation is deliberately broad. Once carried out, the assessment should be reviewed whenever there is a material change to the premises, the occupancy, or the processes carried out within them, and, at a minimum, annually for higher-risk properties such as HMOs and residential blocks.
