Legal Requirement
The Regulatory Reform (Fire Safety) Order 2005, reinforced by the Fire Safety Act 2021, places a legal duty on the "responsible person" of any non-domestic premises to carry out, or commission, a suitable and sufficient fire risk assessment.
Failure to have a valid assessment in place is a criminal offence. Enforcement notices, unlimited fines, and even imprisonment can follow. Your building's insurance may also be invalidated without one. The legislation is deliberately broad. Once carried out, the assessment should be reviewed whenever there is a material change to the premises, the occupancy, or the processes carried out within them, and, at a minimum, annually for higher-risk properties such as HMOs and residential blocks.

Common Questions
Yes — for most non-domestic premises. The Regulatory Reform (Fire Safety) Order 2005 requires the "responsible person" of any non-domestic building to carry out, or commission, a suitable and sufficient fire risk assessment. This includes businesses, landlords of HMOs and residential blocks with communal areas, and managers of premises open to the public. The Fire Safety Act 2021 extended this to include the structure and external walls of multi-occupied residential buildings.
A site visit typically takes between 1.5 and 4 hours, depending on property size and complexity. A small office or shop can usually be completed in under two hours; a larger warehouse, hotel, or multi-storey block will take longer. Your written report is then delivered within 2–3 weeks of the site visit, or faster for urgent cases.
The legislation requires your assessment to be "suitable and sufficient" at all times, which means it must be reviewed whenever there is a significant change — to the building, its use, its occupancy, or the people working in it. As a practical rule, most businesses and landlords review annually. Higher-risk premises such as HMOs, care homes, and hotels should review at least once a year regardless.
Operating premises that require a fire risk assessment without one is a criminal offence under the FSO 2005. The Fire and Rescue Authority can issue enforcement notices requiring you to carry out improvements, prohibition notices restricting or closing your premises, and in serious cases prosecutors can pursue unlimited fines and imprisonment of up to two years. Your buildings insurance may also be invalidated.
Standard single-occupancy domestic dwellings and simple buy-to-let houses are generally not subject to the FSO 2005, so a formal fire risk assessment is not a legal requirement for those. However, if you let a property to multiple unrelated tenants (HMO) or manage a block of flats with communal areas, the legislation does apply — and those are exactly the properties we cover.
